General: ThetaJoin Hosting is built on top of Rackspace Hosting. Hosting Services provided by ThetaJoin must comply to Rackspace's Acceptable Use Policy and Copyrights/Trademarks/Servicemarks.
Site Backups: There is no such thing as 100% reliable backup, but we'll do our best. ThetaJoin does not guarantee the existence, accuracy, or regularity of its backup services and, therefore, Client is responsible for making back-up files in connection with its use of the Drupal Hosting Services. We highly suggest checking your backups often and also keeping a local backup of all Drupal related files and database. The only solution is to have multiple backups that are verified often. Users should always copy all content of a Web site to a local computer and ThetaJoin strongly suggest that Users make an additional copy (on tape, CD, multiple floppy disks, another desktop, or elsewhere) to ensure the availability of the files. IT IS THE USER'S SOLE RESPONSIBILTY TO MAKE OFFLINE, BACK-UP COPIES OF THE USER'S WEB SITE AND USER CONTENT AND DATA. NOTE: IT IS ESSENTIAL THAT USERS BACKUP FILES OFFLINE AND THESE BACKUPS HAVE BEEN TESTED THAT THEY RESTORE CORRECTLY.
The user is responsible for maintaining complete backups for any additional files, content, software, or other items stored on their web server. As part of ThetaJoin's ongoing hosting, ThetaJoin does create and store on a temporary basis daily and weekly server backups which are intended for Thetajoin's disaster recovery, which are typically available only in the event of hardware failure, and only for a short period thereafter. ThetaJoin cannot guarantee the existence, accuracy or completeness of any backups. Please note that typically a complete server restoration from a daily or weekly backup will overwrite anything stored on that server that has been saved in-between backups.
Client has no responsibility for their own backups when using Proxy Server Hosting Services as Client has no access to the proxy servers other than through their own software. No dynamic data is stored on any Proxy Server.
Termination: ThetaJoin reserves the right to refuse service to anyone. To report any unacceptable behavior by a third party using the Services, please contact abuse@thetajoin.com.
Service Fees: Drupal Hosting Services is a 30 day PayPal subscription service paying for the upcoming 30 day period. Payments for services are due within five (5) calendar days of date of subscription or renewal request. Failure to pay for services will require ThetaJoin to change the homepage to a locked account page, with directions on paying for Services. If by the tenth (10th) calendar calendar day past invoice date, the Server will be deleted, and data will NOT be returned. ThetaJoin will NOT email a reminder, Drupal Hosting Services has an automatic renewal, and must be canceled by the client to stop the renewal process.
SEO Proxy Hosting Services is a 30 day PayPal subscription service paying for the upcoming 30 day period. Payments for services are due within five (5) calendar days of date of subscription or renewal request. Failure to pay for services will require ThetaJoin to lock all Proxy Servers from client access. If by the tenth (10th) calendar calendar day past invoice date, all client proxy servers will be deleted. ThetaJoin will NOT email a reminder, DSEO Proky Server Hosting Services has an automatic renewal, and must be canceled by the client to stop the renewal process.
Hourly Services - By the twentieth (20th) of each calendar month, ThetaJoin shall deliver by e-mail to the primary client email account an invoice to Client in accordance with the applicable Service(s) fees as agreed to by the client in the statement of work for Hourly Services in the preceeding month. Payments for services are due by the first (1st) day of each calendar month with no grace period. Failure to pay for services will require ThetaJoin to assess a late fee of 2% per month of the outstanding balance, or turn the account over to a collection service.
TAXES: Client will pay and indemnify and hold ThetaJoin harmless from any and all taxes associated with or arising from Client's use of the Services, including any penalties and interest and any costs associated with the collection or withholding thereof.
DISCLAIMER OF WARRANTY: THE SERVICES, THE ThetaJoin.com website, INCLUDING WITHOUT LIMITATION, ALL SERVICES DISPLAYED OR OFFERED ON THE ThetaJoin.com website, AND ALL INFORMATION IS PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. ThetaJoin DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. ThetaJoin will CANCEL YOUR HOSTING ACCOUNT WITHOUT NOTICE IF THE AFOREMENTIONED DATA IS STORED ON ThetaJoin HOSTED SERVERS. ThetaJoin hosting doesn't collect or store any credit card data. ThetaJoin uses PayPal for all payment services.
Unenforceable Provisions
